BODYKEY® PRIVACY MOBILE APPLICATION TERMS OF USE

1. Access to and use of the BodyKey mobile Application (“App”) and services available through this Appare subject to the following Terms of Use. The words 'we', 'us' and 'Amway' refer to the Affiliates list in Paragraph 17. The words ‘you’ and ‘you’ refer to users of the App who may be Independent Business Owners (ABOs) or Clients.

Acknowledgement and Acceptance of Terms of Use

2. You should read and familiarize yourself with these Terms of Use before using the App. These Terms of Use currently apply but may be amended or edited from time to time. Please read these terms of use carefully before you use this mobile application. By using this App, you expressly agree to be bound by these terms as they are amended or edited from time to time and you acknowledge that you have read, understood and accepted them. However, if after having read these terms of use and you do not agree with them you must discontinue your use of this App.

3. YOUR USE OF THIS APP CONSTITUTES YOUR AGREEMENT TO BE BOUND BY THESE TERMS. PLEASE READ THEM CAREFULLY BEFORE USING THE SITE. IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, YOU MUST NOT USE THIS APP. IF YOU ARE AN AMWAY ABO, YOU ARE BOUND BY ADDITIONAL TERMS AND CONDITIONS CONTAINED IN YOUR AMWAY CONTRACT AND THE RULES OF CONDUCT.

4. Your use of the App is also subject to the terms of our Privacy Policy. You acknowledge that you have read and understand our Privacy Policy, and consent to the use of any personal information you provide in accordance with the terms of, and for the purpose set forth in, our Privacy Policy.

Governing Law

5. All matters and issues relating to the use or interpretation of these terms of use shall be governed by lawsof Singapore.

Intended Use

6. This App is not intended for persons under the age of 18. If you are under 18, you should speak to your parents, your guardian, or a responsible adult and obtain their permission to use this App.

Disclaimer and Limitation of Liability

7. The information, materials and services contained on this App are provided to you on a "as is", and "as available" basis. We do not warrant or guarantee the accuracy or completeness of this information, statements, contents or materials, and expressly disclaim any liability for any errors, omissions and/or inaccuracies in this information, statements, contents and materials. We shall endeavor its best but is not obliged to correct any inaccuracies, errors, omissions or typographical errors in the information posted to this application, and such information including information on pricing and availability of goods may be changed, amended or updated without notice.

8. All information and content provided on the App are for informational purposes only and is not intended to be a substitute for professional advice, diagnoses or treatment. You should not act on the basis of anything contained on the App without first obtaining specific professional advice. Amway does not promise, guarantee or imply that your use of the information, products and services will reduce your weight or improve your fitness levels.

9. To the maximum extent permitted by law, unless otherwise specified, we disclaim all representations and warranties of any kind, whether express, implied or statutory. In addition, we do not warrant, guarantee or make any representation regarding the security of accounts, or that this is free form destructive material, including but not limited to computer viruses, hackers, or other technical sabotage, nor do we warrant, guarantee or make any representations that access to this App will be fully accessible at all times, uninterrupted, or error-free.

10. To the maximum extent permitted by law, we disclaim liability for any damages including, without limitation, direct or indirect, special, incidental, compensatory, exemplary or consequential damages, losses or expenses, including without limitation lost or misdirected orders, lost profits, lost registrations, lost goodwill, or lost or stolen programs or other data, however caused and under any theory of liability arising out of or in connection with

a. use of this application, or inability to see this App by any party; or

b. any failure or performance, error, omission, interruption, defect, delay in operation or transmission; or

c. line or system failure or the introduction of a computer virus, or other technical sabotage, even if we or our employees or representatives are advised of the possibility or likelihood of such damages, losses or expenses.

11. In the event that any provision(s) contained in these Terms of Use is held to be invalid or unenforceable for any reason, such invalidity or unenforceability shall not affect the remainder of the terms which shall be construed and enforced as if the invalid or unenforceable term(s) or provision(s) had never existed. Amway's failure to insist upon or enforce strict performance of any term(s) or provision(s) contained herein shall not be construed as a waiver of any terms, provision or right.

Intellectual Property

12. All Rights reserved. Except as stated herein, none of the material may be copied, downloaded, displayed, posted, transmitted used or reproduced in whole or part in any form or by any means for any purposes unless such use is permitted by Amway.

Trademarks

13. All trade names, domain names, brand names, trade symbols, logos, slogans, trademarks or services marks consisting of the name AMWAY and whether followed with an asterisk (*) or TM are trademarks or proprietary interests of Alticor Inc and Amway Corp., Ada, Michigan, USA. There are other trade names, brand names, trade symbols, logos, slogans, trademarks, service marks, brand names, company names, logos, slogan, trademarks or service marks indicated on this App that are the property of their respective owners.

14. The App may contain numerous links to other Internet Sites including, without limitation, i.e. other affiliation sites and sites that may provide advice or other goods and services which are operated by third party vendors. The provision of the link does not mean that we endorse or accept any responsibility for the content, use, or products and services made available through the associated sites. By utilizing these links, you acknowledged and agreed that we are not responsible for the actions, contents, accuracy, privacy, policies, opinions expressed, services provided, goods sold, or other links provided by these sites. You further acknowledged and agreed that we are not responsible either directly or indirectly for any damage or loss caused by use of or reliance on linked sites. Should you have any questions regarding these application, you should address them directly with the relevant application administrator.

Dispute Resolutionts

15. Any dispute arising in connection with these Terms of Use or in connection with the use of the Appwhich cannot be resolved by good faith negotiations shall be referred to mediation or to arbitration by agreement between us. Any IBO dispute shall be dealt with in accordance with the IBO Rules of Conduct.

No Unlawful or Prohibited Use

16. As condition of your use of the App, you will comply with all applicable laws, statutes, ordinance and regulations regarding your use of our service and any related activities. In addition, you warrant that you will not use the Appfor any purposes that is unlawful or prohibited in law or by these terms, conditions and notices. You agree:

a. Not to upload, post, email or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive if another privacy, hateful, or racially, ethnically or otherwise objectionable.

b. Not to upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, file or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

c. Not to collect or store personal data about other users.

d. Not to interfere with or disrupt the service or services or networks connected to the service, or disobey any requirements, procedures, policies or regulations of the networks connected to the service.

How to Contact Us

17. Allow to Use Google Fit https://www.googleapis.com/auth/fitness.activity.read and https://www.googleapis.com/auth/fitness.location.read to receive the step and distance information of Google activity data to calculate further information about your activity, such as distance run through Bodykey app and sync the changes with Google fit. so you will check the details of daily step information in the Bodykey app.

1. การเข้าถึงและการใช้งานเว็บไซต์ www.nutrilite.co.th/th และแอพลิเคชั่นบอดี้คีย์ผ่านโทรศัพท์มือถือ (“แอพพลิเคชั่น”) และบริการผ่านทางแอพพลิเคชั่นนี้อยู่ภายใต้ข้อกำหนดการใช้งานดังต่อไปนี้ คำว่า ‘เรา’ ‘พวกเรา’ และ ‘แอมเวย์’ หมายถึงบริษัทสาขาตามที่ระบุในข้อ 18 คำว่า ‘คุณ’ และ ‘คุณ’ หมายถึงผู้ใช้แอพพลิเคชั่นและเว็บไซต์ซึ่งอาจเป็นนักธุรกิจแอมเวย์ (นธอ.) หรือลูกค้า

การรับทราบและยอมรับข้อกำหนดการใช้งาน

4. การใช้งานแอพพลิเคชั่นนี้ของคุณยังอยู่ภายใต้นโยบายความเป็นส่วนตัวของเรา คุณยอมรับว่าคุณได้อ่านและเข้าใจนโยบายความเป็นส่วนตัวของเรา และยินยอมที่จะให้มีการใช้ข้อมูลส่วนตัวใดๆ ที่คุณให้ไว้ตามข้อกำหนดและเพื่อวัตถุประสงค์ที่กำหนดไว้ในนโยบายความเป็นส่วนตัวของเรา

การปฏิเสธและการจำกัดความรับผิด

7. ข้อมูล เนื้อหา และบริการที่ส่งมอบให้คุณในแอพพลิเคชั่นนี้อยู่บนพื้นฐาน “ตามที่เป็น” และ “ตามที่มีอยู่” เราไม่รับประกันหรือรับรองความถูกต้องหรือสมบูรณ์ของข้อมูล ข้อความ องค์ประกอบ หรือเนื้อหานี้ และปฏิเสธความรับผิดใดๆ ต่อข้อผิดพลาด การละเว้น และ/หรือ ความไม่ถูกต้องในข้อมูล ข้อความ องค์ประกอบ หรือเนื้อหานี้ เราจะพยายามอย่างดีที่สุด แต่ไม่เป็นเหตุบังคับให้ต้องแก้ไขความไม่ถูกต้อง ข้อผิดพลาด การละเว้นใดๆ หรือข้อผิดพลาดในการพิมพ์ข้อมูลที่เผยแพร่ในแอพพลิเคชั่น และข้อมูลดังกล่าวนั้นหมายรวมถึงข้อมูลของราคาและความพร้อมจำหน่ายของสินค้าซึ่งอาจมีการปลี่ยนแปลง แก้ไข หรือปรับปรุงโดยไม่ต้องแจ้งให้ทราบล่วงหน้า

8. ข้อมูลและเนื้อหาทั้งหมดในแอพพลิเคชั่นมีวัตถุประสงค์เพื่อให้ข้อมูลเท่านั้นและไม่ได้มีวัตถุประสงค์เพื่อทดแทนคำแนะนำ การวินิจฉัย หรือการรักษาโดยผู้เชี่ยวชาญ คุณไม่ควรปฏิบัติโดยยึดถือสิ่งใดๆ ก็ตามในแอพพลิเคชั่นโดยไม่ขอคำปรึกษาจากผู้เชี่ยวชาญเสียก่อน แอมเวย์ไม่ขอสัญญาหรือรับประกันหรือบ่งบอกว่าการใช้ข้อมูล ผลิตภัณฑ์ และบริการของคุณมีผลจะให้น้ำหนักตัวลดลงหรือเพิ่มระดับความแข็งแรงของคุณ

9. ตามขอบเขตสูงสุดตามที่กฎหมายอนุญาตเว้นเสียแต่ระบุเป็นอย่างอื่น เราขอปฏิเสธการรับรองและการรับประกันใดๆ ไม่ว่าโดยชัดแจ้ง โดยนัย หรือตามกฎหมาย นอกจากนี้ เราไม่ขอรับประกันหรือให้การรับรองใดๆ เกี่ยวกับความปลอดภัยของบัญชีผู้ใช้หรือว่าปราศจากสิ่งที่ทำให้เกิดความเสียหาย รวมถึงแต่ไม่จำกัดเพียงไวรัสคอมพิวเตอร์ แฮกเกอร์ หรือการก่อวินาศกรรมทางเทคนิคอื่นๆ อีกทั้งเราไม่รับรอง รับประกัน หรือให้สัญญาว่าการเข้าถึงแอพพลิเคชั่นนี้จะสามารถทำได้อย่างสมบูรณ์ตลอดเวลา ไม่ติดขัด หรือปราศจากข้อผิดพลาด

10. ตามขอบเขตสูงสุดตามที่กฎหมายอนุญาต เราปฏิเสธความรับผิดต่อความเสียหายใดๆ อันรวมถึงแต่ไม่จำกัดเพียงความเสียหาย ความสูญเสีย หรือค่าใช้จ่ายโดยตรง โดยอ้อม พิเศษ อุบัติเหตุ การชดเชย เพื่อเป็นเยี่ยงอย่างหรือเป็นผลสืบเนื่อง รวมถึงแต่ไม่จำกัดเฉพาะคำสั่งซื้อที่สูญเสียหรือผิดพลาด การสูญเสียผลประโยชน์ การสูญเสียสมาชิก การสูญเสียค่านิยม การสูญเสียหรือถูกขโมยโปรแกรมหรือข้อมูลอื่นๆ ที่เกิดจากและอยู่ภายใต้ทฤษฎีความรับผิดใดๆ ที่เกิดขึ้นจากหรือเกี่ยวเนื่องกับ

ก. การใช้งานแอพพลิเคชั่นนี้ หรือการไม่สามารถเห็นแอพพลิเคชั่นนี้โดยฝ่ายหนึ่งฝ่ายใด หรือ

ข. ความล้มเหลวใดๆ หรือประสิทธิภาพ ข้อผิดพลาด การละเว้น การหยุดชะงัก ข้อบกพร่อง ความล่าช้าในการดำเนินการหรือการส่งสัญญาณ หรือ

ค. ความล้มเหลวของสายหรือระบบ หรือการติดไวรัส หรือการก่อวินาศกรรมทางเทคนิคอื่นๆ แม้ว่าเรา หรือพนักงาน หรือตัวแทนของเราจะทราบถึงความเป็นไปได้หรือโอกาสที่จะเกิดความเสียหาย การสูญเสีย หรือค่าใช้จ่ายดังกล่าว

11. ในกรณีที่บทบัญญัติใดๆ ในข้อกำหนดการใช้งานนี้เป็นโมฆะหรือไม่มีผลบังคับใช้ไม่ว่าด้วยสาเหตุใดก็ตาม การเป็นโมฆะหรือไม่มีผลบังคับใช้นั้นจะไม่ส่งผลกระทบต่อข้อกำหนดที่เหลือซึ่งจะถูกตีความและบังคับใช้เสมือนบทบัญญัติหรือข้อกำหนดที่เป็นโมฆะหรือไม่มีผลบังคับใช้นั้นไม่เคยเกิดขึ้น ความล้มเหลวของแอมเวย์ในการยืนกรานหรือบังคับให้มีการปฏิบัติอย่างเคร่งครัดตามข้อกำหนดหรือบทบัญญัติใดๆ ในเอกสารฉบับนี้จะต้องไม่ถูกตีความว่าเป็นการสละสิทธิ์ในข้อกำหนด บทบัญญัติ หรือสิทธิใดๆ

ทรัพย์สินทางปัญญา

12. สงวนลิขสิทธิ์ เว้นแต่ตามที่ระบุไว้ในเอกสารฉบับนี้ ห้ามมิให้คัดลอก ดาวน์โหลด แสดง โพสต์ ส่งต่อ หรือทำซ้ำข้อมูลทั้งหมดหรือส่วนหนึ่งส่วนใด ไม่ว่าในรูปแบบใดๆ หรือด้วยวิธีการใดๆ เว้นแต่การใช้งานนั้นจะได้รับอนุญาตจากแอมเวย์

เครื่องหมายการค้า

13. ทุกชื่อการค้า ชื่อโดเมน ชื่อแบรนด์ สัญลักษณ์ทางการค้า โลโก้ คำโฆษณา เครื่องหมายการค้า หรือเครื่องหมายบริการที่มีชื่อแอมเวย์ และไม่ว่าจะตามด้วยเครื่องหมายดอกจัน (*) หรือ TM หรือไม่ก็ตามถือเป็นเครื่องหมายการค้าหรือผลประโยชน์ที่เป็นกรรมสิทธิ์ของอัลติคอร์ อิงค์ และแอมเวย์ คอร์ปอเรชั่น เมืองเอด้า รัฐมิชิแกน สหรัฐอเมริกา นอกจากนี้ยังมีเครื่องหมายการค้า ชื่อโดเมน ชื่อแบรนด์ สัญลักษณ์ทางการค้า โลโก้ คำโฆษณา เครื่องหมายการค้า เครื่องหมายบริการ ชื่อบริษัทอื่นๆ ที่ระบุในแอพพลิเคชั่นนี้ซึ่งเป็นกรรมสิทธิ์ของเจ้าของที่เกี่ยวข้อง

การระงับข้อพิพาท

15. ข้อพิพาทใดๆ ที่เกิดขึ้นอันเกี่ยวข้องกับข้อกำหนดการใช้งานเหล่านี้หรือเกี่ยวข้องกับการใช้งานแอพพลิเคชั่นซึ่งไม่ สามารถแก้ไขได้ด้วยการเจรจาอย่างสุจริตจะถูกส่งต่อไปยังการไกล่เกลี่ยหรืออนุญาโตตุลาการตามข้อตกลงระหว่างเรา ข้อพิพาทใดๆ ระหว่างนักธุรกิจแอมเวย์จะต้องจัดการตามระเบียบปฏิบัติของนักธุรกิจแอมเวย์

ห้ามการใช้งานที่ผิดกฎหมายหรือต้องห้าม

16. ตามเงื่อนไขการใช้งานแอพพลิเคชั่นของคุณ คุณจะปฏิบัติตามกฎหมาย บทบัญญัติ กฎ และข้อบังคับทั้งหมดเกี่ยวกับการใช้บริการของเราและกิจกรรมใดๆ ที่เกี่ยวข้อง นอกจากนี้ คุณรับรองว่าคุณจะไม่ใช้แอพพลิเคชั่นนี้เพื่อวัตถุประสงค์ใดๆ ที่ขัดต่อกฎหมายหรือต้องห้ามตามกฎหมาย หรือด้วยข้อกำหนด เงื่อนไข และประกาศเหล่านี้ คุณตกลงที่จะ:

ก. ไม่อัพโหลด โพสต์ ส่งอีเมล หรือส่งเนื้อหาใดๆ ที่ผิดกฎหมาย เป็นอันตราย คุกคาม ข่มขู่ ปรามาส รังควาน ละเมิด หมิ่นประมาท หยาบคาย ลามกอนาจาร ใส่ร้าย รุกล้ำความเป็นส่วนตัว มุ่งร้าย หรือเหยียดเชื้อชาติ ชนชาติ หรือเป็นที่รังเกียจ
